Foal Payment Plan

 

 

Just think of it........ you can pay on your foal before it is born and have it all paid for when weaned.  Or make a deposit to hold your unborn foal and pay for it when it comes. The mare determines each foal’s price that you choose for your in utero foal.

If you have always dreamed of owning an Andalusian blood horse but just have not had the money up front......This may be your dream come true.  Next years foals from Faraon De La Montana and my mares are available on a Contract Payment Plan while the mare is in foal.  I want these foals to go to good loving homes where they will be cared for.  Serious inquiries only please.  You must be 18 years of age or older and have the means to care for the foal when you purchase one. 

 
This is how it works:
 
Choose a mare from my farm that you would like a foal from who's foal is not spoken for this year or even the following year if you wish.  Faraon De La Montana will be the foals sire.  Live Foal Guarantee, more details in the Contract.  (Go to Rare Rock's Brood Mares
 
A deposit is advised to reserve your foal.  When the mare of your choice is settled and confirmed in foal  your payments will start or can start right away if she already is in foal and has not been reserved or already in a contract agreement already.  See foal prices on Brood  Mares page.  If one of the mares you are interested in does not have a price listed for her foal please contact me for more information.  You can also customize your contract to include shipping and registration fee cost also in your payments so that is not a problem for you when the foal is ready to go to your home, this way those costs are covered in advance.  Payments made monthly for 15 months, if you start right when the mare is settled.   Or you can get in on a foal that is not spoken  for at a later date in which case you could pay on a shorter term.  Sorry I can not guarantee color or sex of a foal.  I will go over color possibilities with you later.
 
The foals will be weaned at 4 months of age.  When your foal is paid in full and contract agreement met the foal registration application will be sent with my signature as breeder for IALHA.  And upon payment in full of the foal an application for IALHA registration will be sent to you along with copies of the mare and sire pedigree, then the foal can be shipped to your home at that time .  Your relationship with your dream horse will start.  Shipping and registration costs of the foal is the responsibility of the buyer.  I can help with finding you a responsible, reliable, professional, good horse handler to ship your foal.

In Utero Information

What does buying an In Utero foal mean?

Buying an In-Utero foal is when someone purchases a foal before it is born, or while in utero.

 

Pros:

  • You can obtain a high quality foal for considerably less than you would otherwise be able to.
  • You don't have the regular costs of breeding your own mare.
  • Many times you can get a better quality foal than you may be able to get otherwise because of price of foal already on the ground. 
  • The prices can change after birth due to color or quality of the foal or age, time, training.
 

Cons:

  • You are  not guaranteed color, sex, or conformation
  • You cannot see the foal before you buy it.

Foal Payment Contract

This Contract is by and between Sandra LaRoque (hereinafter referred to as Seller/Owner) of Rare Rock Andalusians (hereinafter referred to as Farm) and _______________________________________(hereinafter referred to as Buyer) of ____________________________________________________________________.  This Contract is binding and all parts of this Contract are in agreement to both parties hereto.

Seller/Owner agrees to sell One (1) _________(year foaled) Foal out of the ______________________________(breed) mare named _____________________________________________ and registered with ________________________________(breed registry),  #_______________________ and by the stallion registered with the International Andalusian & Lusitano Horse Association (IALHA) Andalusian stallion, Faraon De La Montana for the amount of $______________ (hereinafter the foal from the breeding of these two horses will be referred to as , Foal).  If agreed between the parties in this contract, the cost of registration of Foal in the amount of $__________ will be added to the above amount for a total of $______________.  If the parties herein agree that the amount of transportation by a horse hauling company be added, then the total amount of $_________________ will be added.  The total amount of this contract to be paid to Seller/Owner by Buyer is therefore $______________ and will be made by Buyer, in installments for _______months.  A down payment in the amount of $_______________will be paid by Buyer and applied to the balance to reserve the purchase of this Foal.  Down Payment is considered the 1st month payment.  It is agreed that Buyer will pay______ number of payments of $_______________with the final month payment being $_____________until the full amount of $___________________is paid to Seller/Owner.  The Foal will be ________months old and will be required to be transported or picked up by Buyer by no later than _______months old.

Payments are due to the Seller/Owner on the 1st Day of each month and no later than the 15th Day of each month.  A late fee of  $20 will be charged for any time Buyer is later than the 15th getting payment to Seller/Owner (in her mailbox by the 15th).  If Buyer fails to make all of the required payments by the time the Foal is ________months of age (unless agreeable arrangements between the parties herein have been made in writing and signed by both parties herein) than this contract is null and void and none of the money paid by Buyer to Seller/Owner will be refunded by Seller/Owner.  The Foal will be considered abandoned by the Buyer at this point.  (More details on this mentioned later in contract).  If for any reason that the payments have not all been made by the time the Foal is this age but arrangement have been made to extend the Contract time then interest charge will be added which is 15% of the total amount of this contract will be added  to this Contract  price/total and payable by Buyer to Owner/Seller.

If the Buyer quits making payments entirely no money paid toward the Foal will be refunded. 

 

The Live Foal Guarantee by Seller/Owner is this:

A)  Foal stands and nurses at time of birth and is alive and healthy according to Seller/Owner at time of transport to Buyer.  Foal is sold as is; color, sex and healthy according to Seller/Owner.

B)  The Foal will not and can not leave the Farm until all parts of this agreement are met.  That is; all payments have been made in full and all incurred expenses, if any apply, have been paid.

C)  If the Foal, after time of its conception, for any reason, dies before birth or is still born, or any time before transport or pick up by the Buyer, then an alternate Foal from a different mare, of any breed that is available, on the Farm, and that is by Faraon De La Montana will be chosen by Seller/Owner to replace the Foal.  The Buyer also has the option to choose to wait for a Foal from the same mare mentioned above in this Contract for the following year (if that foal is not already sold for the following year to another party.  In this instance another foal will be chosen by another mare on the farm).  No money's paid by Buyer in this instance will be refunded by Seller/Owner.  Any moneys paid will go toward the following year Foal or alternate Foal.

D)  If  Mare fails to settle in foal/conceive at all after a deposit has been made by Buyer for a Foal from Mare, if any were made, will be refunded to the Buyer.   This means that if you choose a mare before she has been covered by Faraon De La Montana or before confirmed in foal for said breeding between Mare and Stallion in this Contract.   This does not mean the same as referring to rules A threw C where the mare IS confirmed in foal already at the time of deposit.  If Buyer wishes, an alternate Foal from a different mare can be chosen and all parts of this contract will continue if alternate foal is priced the same with the change of mare name.  In this instance, all money paid will apply to above written in A through C rules.

E)  If the buyer is 20 days past due there will be a $20.00 late payment fee added to the next months payment.   Should Buyer fail to make payments within 30 days of
due date without prior authorization from Seller,
Seller may have the option to declare the balance of
the note then owing to be due and payable immediately.
 
The Buyer understands and agrees that Seller/Owner does not and will not and can not guarantee the sex or color of the Foal and that this contract is binding knowing this fully.  You are buying Foal regardless of color or sex.  The Buyer is bound by this contract to except the color and sex of the Foal at the time of birth and thereafter.

All veterinarian charges while the Mare is carrying the Foal and until the Foal is transported or picked up at age specified in this contract by the Buyer, which ever comes 1st, are the responsibility of the Seller/Owner.  All veterinarian charges after the Foal leaves the Farm at age specified in this Contract are the soul responsibility of the Buyer.  The Seller/Owner is not responsible for the Foal in any way after the Foal leaves the Farm.  The Foal will be given it's 1st oral de-worming and given it's immunizations that are able to be given in consideration to the age to the Foal before it leaves the Farm.  All other following immunizations, worming and veterinarian care is the responsibility of the Buyer after Foal leaves the Farm.   Seller/Owner will not be held responsible to any instances of illness, injury or death of the Foal after it leaves the Farm.  

If the Buyer does not make arrangements to transport or pick up the Foal after the age of ______months and no later than, _______ months of age, a boarding fee pf $8.00 per day thereafter will be charged by Seller/Owner to Buyer and all incurred farrier, veterinarian charges after ________months of age will be billed to Buyer and payable to the Seller/Owner and required to be paid in full before the Foal is transported or picked up.  If the Foal is not transported or picked up by ________months of age the Seller/Owner will assume and consider the Foal  is abandoned by the Buyer and will become the soul property of the Seller/Owner and will be sold or auctioned or kept and no moneys paid for Foal by Buyer will be refunded to the Buyer unless both parties have agreed on other arrangement in writing and signed by both parties herein.  

All contents of this contract have been read and understood fully by Buyer and are binding in all aspects.  No other person or persons can change this Contract except the parties herein and BOTH parties would have to agree and put in writing and sign any changes.  This contract is legal under North Dakota laws.
